^{1 Rental Period
The rental period begins, within Germany two days and abroad three days after the departure date of the rental object from the Singen facility as certified on the lessor’s bill of lading.}

^{The minimum rental period is one week; from the 8th day onward, billing is calculated on a daily basis.}

^{It ends, within Germany two days and abroad three days before the arrival date of the rental object at the Singen facility as certified on the lessee’s bill of lading.}

^{2 Shipping
Shipping occurs upon receipt of the order / confirmation of the rental offer and availability of the rental equipment.}

^{3 Transport, Transport Risk
The lessee bears all transport costs from/to Singen as well as the transport risk.}

^{4 Rental Rates
The rental rates specified in the rental agreement apply. The rental rates are weekly rental rates. Partial weeks are calculated in proportion to the remaining rental days. One rental week has seven (7) rental days. Non-working days and public holidays cannot be deducted by the lessee.}

^{Rental invoices are payable net upon receipt. Invoicing generally occurs at the end of the month. However, the lessor is entitled to demand advance payments.}

^{5 Ownership
The rental object remains the property of the lessor throughout the entire rental period until any potential purchase. The lessee may not dispose of it to the detriment of the lessor and must keep it free from seizure, encumbrances, and other claims by third parties. Should any of the aforementioned circumstances occur, the lessor must be notified immediately.}

^{6 Sublease
The lessee is authorized to sublease the rental object to a third party.}

^{7 Warranty
The lessee must check the rental object for completeness upon receipt. Any defects must be reported immediately upon receipt of the rental object.}

^{The lessor provides a fully functional rental object.
Should damage occur to the rental object due to improper operation, storage, handling, or shipping that does not fall under normal wear and tear, the lessee will be charged for the repair costs.
Lost materials will be charged at the current sales prices.}

^{8 Lessor’s Liability / Exclusion of Damages
Claims for damages by the lessee on any legal grounds, particularly from tort, product liability, incorrect advice, positive breach of contract, culpa in contrahendo, or impossibility, are excluded for slight negligence on the part of the lessor.}

^{This exclusion of liability does not apply to liability independent of fault, particularly the absence of warranted characteristics and for defects in the rental object for which liability is mandatory under applicable product liability laws.}

^{9 Insurance
The lessee is liable to the lessor for burglary, theft, and fire damage to the rental object. The lessee is recommended to obtain appropriate insurance coverage.}

^{10 Return of Rental Object
Unless the lessee purchases the rental object, it must be returned to the lessor after expiration of the agreed rental period, or at the latest after expiration of the maximum rental period, externally cleaned and in the original packaging.}

^{11 Purchase of Rental Object
The lessee is entitled to purchase the rental object at any time.}

^{Valid exercise of the purchase right is subject to the suspensive conditions of timely payment of the purchase price.}

^{Paid rental fees will be credited toward the purchase price at 75%, up to a maximum of 13 weekly rentals.
Upon purchase, the General Terms and Conditions of Sale for Orbitalum Tools GmbH apply. The rental period will be credited toward the warranty period.}

^{The purchase price is due net within 30 days of invoicing.}

^{12 Written Form
Amendments and supplements to the rental agreement require written form to be valid.}

^{13 Applicable Law, Jurisdiction
Our general terms and conditions of sale apply.
German law applies. Place of jurisdiction and performance is D-78224 Singen.}
